Article 1 - Purpose
These terms and conditions govern sales by Trésors des mers
Article 2 - Prices
The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and exclusive of processing and shipping costs. If you order from a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the company. Managing Director. You are entirely responsible for declarations and payments to the relevant authorities and organisations in your country. We advise you to check these aspects with your local authorities. All orders, whatever their origin, are payable in euros. The company Managing Director reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is validated and subject to availability. The products remain the property of the company Managing Director until the price has been paid in full. Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
Article 3 - REGISTRATION AND VALIDATION OF ORDERS
3.1 Browsing the Site
The User can find out about the different Products offered for sale by Trésors des mers on its Site.
The User may browse freely through the various pages of the Site without being bound by any order.
3.2 Registering an order
If the User wishes to place an order, he/she will select the various Products in which he/she is interested, and will express this interest by clicking on the «shopping basket» icon.
The User may at any time:
- obtain a summary of the Products they have selected, by clicking on the basket.
- continue or modify your selection of Products by clicking on “Continue shopping”.
- complete its selection of Products and order these Products by clicking on “Proceed to payment”.
To order the Products they have chosen, after clicking on “Proceed to payment”, Users must identify themselves by entering their e-mail address and the password they chose when creating their account or, if this is their first order, by clicking on «Create an account». In the latter case, the User must accurately complete the form provided, on which he/she must include the information required for identification, in particular his/her surname, first name and postal address. In addition, Users must provide their e-mail address and a password of their choice, which will be personal and confidential and which they will need to identify themselves later on the Site.
The User is informed and accepts that entering these two identifiers is proof of his/her identity and expresses his/her consent.
Once the User has been identified, he/she must validate the delivery address and an order form will appear on the screen, summarising: the nature, quantity and price of the Products selected by the User, as well as the total amount of the order, the delivery costs, the delivery time, the User's contact details and the delivery address for the Products.
Commercial offers
To benefit from a commercial offer that has been sent to them, Users must enter and validate their ”promotional code“ in the field provided on the payment page.
3.3 Final confirmation of the order and payment
After checking the status of the order, and once all the information requested has been completed by the User, a summary of this information and of the order will appear and the User will have to choose the method of payment with which they wish to make their payment in order to confirm their order definitively.
Orders are payable in :
- euros by French or international bank card
It is specified that when immediate payment is made by credit card, this is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data linked to means of payment, and that at no time will the User's bank details pass through the Trésors des mers computer system.
As soon as the User confirms payment, the order is recorded. The User becomes a Customer. The order form will be recorded on the computer registers of Trésors des mers and will be considered as proof of the contractual relations between the Parties.
The Customer has a right of withdrawal and reimbursement within fourteen (14) working days from the date of receipt of the Products by the Customer.
3.4 Order confirmation
A summary of the order will be displayed once the order has been validated.
This confirmation will include all the constituent elements of the contract between the Parties.
This order summary will also be sent by e-mail to the Customer within minutes of the purchase.
The Customer will then have access to “order tracking” by clicking on “Log in” and logging in using their e-mail address and password.
3.5 Modifying an order
Orders placed can be tracked from the «Log in» menu.
To modify an order, it is necessary to cancel the order, put it back in the basket and then correct it as required before validating it.
An order can only be modified or cancelled when its status is «Registered».
An order placed in «in preparation» or «dispatched» status can no longer be modified.
Article 4 - Payment
The fact of validating your order implies for you the obligation to pay the price indicated. Payment for your purchases is made by credit card using a secure system. The card is only debited when the order is dispatched. In the case of split deliveries, only the products dispatched will be debited.
Article 5 - RETURNS - REFUNDS AND RIGHT OF WITHDRAWAL
Conditions of withdrawal
The Customer has a right of return of fourteen (14) days from the date of receipt of the totality of his order to retract without necessarily giving a reason.
To exercise the right of withdrawal, customers must notify their decision to withdraw from their order in an unambiguous statement, specifying their full name, e-mail address, address, order number and date:

Reimbursement
If the Customer withdraws, Trésors des mers will reimburse the payments received from the Customer and, in any event, no later than fourteen (14) days from the day on which Trésors des mers is informed of the Customer's decision to withdraw.
If the Customer withdraws from the entire order, Trésors des mers will refund all payments received from the Customer for this order.
If the Customer withdraws from part of the Products in the order, Trésors des mers will reimburse the amount of the Products returned.
The refund will be made by the same means of payment that the Customer used for his/her order or by bank transfer.
Trésors des mers may defer this reimbursement until it has received and checked the Products.
Product returns
The Customer must return the Products no later than fourteen (14) days after communicating his/her decision to withdraw.
Products returned must be unopened, complete and undamaged.

The Customer shall bear the cost of returning the entire order or the Products.
Article 6 - Delivery
Products are delivered to the delivery address indicated during the order process, within the time indicated on the order confirmation page. In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences for the delivery time indicated. In accordance with legal provisions, in the event of late delivery, you may cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code. If, in the meantime, you receive the product, we will reimburse you and the delivery costs in accordance with Article L 138-3 of the French Consumer Code. In the case of deliveries by a carrier, the company Managing Director cannot be held responsible for delays in delivery due exclusively to the customer's unavailability after several proposed appointments.
Article 7 - Guarantee
All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as set out in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed. All claims, requests for exchange or refund must be made within 30 days of delivery. Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of proof. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 8 - Liability
The products offered comply with current French legislation. The responsibility of the company Managing Director shall not be held liable in the event of failure to comply with the legislation of the country to which the product is delivered. It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you intend to order. Furthermore, the company Managing Director shall not be held liable for any damage resulting from improper use of the product purchased. Finally, the liability of the company Managing Director cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
Article 9 - Applicable law in the event of disputes
The language of this contract is French. These conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 10 - Intellectual property
All elements of the Trésors des mers website are and remain the exclusive intellectual property of the company Managing Director. No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of the company. Managing Director. Article 13 - Personal data The company Managing Director reserves the right to collect nominative information and personal data about you. This information is required to process your order and to improve the services and information we send you. It may also be transmitted to companies that contribute to this relationship, such as those responsible for carrying out services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the law of 6 January 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.
Article 11 - Archiving Evidence
The company Managing Director will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code. The computerised records of the company Managing Director will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
